Terms of service

These terms are an agreement between you and Molicule LLC, a Delaware limited liability company (“Kofounder”, “we”, “us”). They apply when you join the waitlist or use Kofounder. By doing either, you agree to them. If you use Kofounder for a company, you agree on its behalf and confirm you're allowed to.
Our privacy policy explains how we handle your data.
1. The beta
Kofounder is in private beta. Access is by invitation from the waitlist, and we decide whom to invite and when. Features are incomplete, may change or be removed without notice, and things will sometimes break or lose work. Don't rely on the beta as your only copy of anything important. We may pause or end beta access at any time.
2. Your account
You must be at least 18 and give accurate information. One account per person, and don't share your login. You're responsible for activity under your account and for keeping your sign-in secure. Tell us at hello@kofounder.ai if you think it has been compromised.
3. Credits and fees
The beta includes a free daily and monthly allowance of credits for AI work. Credits have no cash value, can't be transferred or sold, and unused credits don't roll over. We may change the allowance, and we may grant extra credits at our discretion. If we introduce paid plans, we'll show the price and get your agreement before charging you.
4. Your content and what Kofounder makes
You keep all rights to what you put into Kofounder: your ideas, answers, messages and files (“your content”). As between you and us, you also own the research, plans, designs and code Kofounder generates for you (“output”), and you may use them for any lawful purpose, including commercially.
You give us a limited licence to host, copy, process and transmit your content and output only as needed to run Kofounder for you and to keep it secure. We don't use your content to train AI models.
You're responsible for your content and confirm you have the rights to it.
5. AI output
Output is generated by AI and can be wrong, incomplete, out of date or insecure. Research, market sizes, prices and verdicts are informational only. They are not legal, financial, investment or other professional advice. Similar requests from other people may produce similar output, so we can't promise output is unique. Review everything before you rely on it, and test and secure generated code before you put it in front of users or handle their data.
6. Connected services and your app
When you connect GitHub, Supabase or another service, you authorise Kofounder to act in that account on your behalf, for example creating repositories, projects and tables. Your use of those services is governed by their own terms, and any fees they charge are yours. You're responsible for the apps you build and run, including their compliance with law and their privacy notices.
7. Acceptable use
Don't use Kofounder to:
- break the law or infringe anyone's rights, including intellectual property and privacy;
- build malware, phishing, scams, spam, or anything designed to deceive or harm people;
- get around credit limits or access controls, create multiple accounts, or share an account;
- probe, overload or disrupt our systems, or access them by automated means other than our own interfaces;
- copy, resell or reverse-engineer Kofounder, or use it to build a competing service.
We may remove content or suspend accounts that break these rules.
8. Feedback
If you send us feedback or suggestions, we may use them to improve Kofounder without any obligation to you.
9. Our property
Kofounder, including its software, design system, prompts, interface and brand, belongs to us. These terms don't give you any rights to it beyond using the service as described here.
10. Suspension and ending
You can stop using Kofounder at any time and ask us to delete your account. We may suspend or end your access if you break these terms, if your use creates risk or harm for us or others, or when the beta ends. Where reasonable, we'll give you notice and a chance to export your work. Code and databases in your own GitHub and Supabase accounts stay yours either way. Sections 4 (licence aside), 5, 8, 9 and 11 to 14 survive.
11. No warranty
Kofounder is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement, and we don't promise the service will be uninterrupted, error-free or secure.
12. Limitation of liability
To the fullest extent the law allows, Kofounder won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if we were told they were possible. Our total liability for all claims relating to Kofounder is limited to the greater of the amount you paid us in the 12 months before the claim or US $100.
13. Indemnity
You'll defend and indemnify Kofounder against third-party claims arising from your content, the apps you build or run, or your breach of these terms, including reasonable legal fees.
14. Governing law and disputes
These terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and both of us consent to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally within 30 days.
15. Changes and general terms
We'll update the date at the top when these terms change, and email account holders at least 30 days before material changes take effect. Continuing to use Kofounder after that means you accept the new terms.
These terms (with the privacy policy) are the whole agreement between us about Kofounder. If any part is unenforceable, the rest still applies. Not enforcing a right isn't a waiver. You can't transfer these terms without our consent; we may transfer them with the business.
